Unless otherwise indicated, this Privacy Policy applies only to information collected via the Site, and not to any off-line or non-Site related activities of Spy Optic Inc. or its affiliates.

Gathering and Use of Information

Spy Optic Inc. may collect information ("Information") from you in various different ways and through various different parts of our Site, for example, when you (1) buy one of our products through the Site, (2) enter one of our contests, (3) subscribe to our online newsletter, (4), register to become a member or use particular features of the Site or (5) post a submission in posting areas. Such Information may include your first and last name, email address, user name, password, gender, address, zip code, age, credit card information, and other information relating to you, as discussed in more detail below. All passwords collected by Spy Optic Inc. on the Site are stored with an irreversible encryption logarithm and are never visible to Spy Optic Inc. employees. Even if you are just surfing the Site, we may collect Information from you, such as your IP address and the particular web pages that you visit on our Site.

In general, we use the Information we collect to process your purchases, and to provide you with better information regarding the services offered through our Site, as discussed in more detail below.

Information Pertaining to Children and Minors

Spy Optic Inc. does not want to collect information from minors (children under 13 years of age, or any other age defined under applicable law) and does not intentionally collect information from minors. If we become aware that a minor is attempting to or has submitted information via this site, we will notify the user that we may not accept his or her information. We will then use our commercially reasonable best efforts to expunge any personally identifiable information from our records. Product Orders

If you choose to order merchandise from Spy Optic Inc., we will collect your product order along with your billing and shipping information. This Information is used to fulfill your order and bill you for your purchase, and also may be used to analyze our product sales so that we can better meet your needs. Our products may be shipped directly by the vendor, in which case we will share with them the required information to complete the shipping of your items. Please be aware that some products are made available by third parties on third party web sites, in which case this privacy policy will not apply to such orders as described more fully in the section below concerning Third Party Links and Web Sites.

You need to be at least 18 years of age or have the express permission of your parent or guardian to make purchases on or Site (if you are under 18, please ask your parent or guardian for assistance). Your credit card information will be sent to one of our service providers for processing. Credit card information is securely processed by our merchant provider using SSL encryption and the highest levels of PCI Compliance for all transactions.


Spy Optic Inc. may from time to time offer entry into online contests. Unless otherwise specified, you must be at least 13 years of age to enter a contest, (if you are under 18 years of age, please ask your parent or guardian for assistance) and otherwise comply with the rules established for the contest. You may be asked to provide your name, mailing address, email address, and your phone number and other information. Depending on the nature of the contest, we may also request information regarding customer (your) preferences, such as your interests, favorite bands or types of music. Information you provide will be stored in or along with your registration profile and used to provide you with information on bands, types of music, and other products and services we believe will be of interest to you.

We use your contact information to notify winners. Additionally, you may choose to receive information from contest sponsors. If you so choose, Spy Optic Inc. will also share your Information with contest sponsors. Otherwise, we do not share personally identifiable contest-related Information with third parties, except as otherwise indicated in this Privacy Policy.

Spy Optic Inc. Online Newsletter

We like to keep you informed about the latest news, merchandise, special offers, contests, promotions through our online newsletter. In order to sign up, we may request your name, zip code, gender, age and e-mail address. We use this Information in the ways set forth in this Privacy Policy.

Online Posting Areas or Blogs

If you use a Posting Area or Blog on the Site, you should be aware that any information you share is visible to other users. Personally identifiable information you submit to one of these posting areas can be read, collected, or used by other individuals to send you unsolicited messages. In the event of a merger, acquisition, consolidation, or sale of all or substantially all the assets of Spy Optic Inc., or in the unlikely event of a bankruptcy, we reserve the right to transfer all or part of our business, including this site and your Information, to third parties.

Saving Information and Security

Your personal Information is contained behind secured networks. Please be aware, however, that no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal Information, Spy Optic Inc. cannot insure or warrant the security of any Information you transmit to us or from our online products or services. If the event of a breach of the security of a member's personal Information, we will notify you of such incident through the most current email address you provided to us.

We used secure servers when transmitting personal information. We also use what we believe are industry-standard technologies when transferring and receiving payment data. We have security measures in place with our payment provider and, where applicable, in our physical facilities intended to protect against the loss, misuse, or alteration of information that we have collected from or about you. When we take an order from you, we only ask for the information necessary to process your order. When we process a credit card transaction, your information is forwarded directly to our credit card processor for authorization and is not stored on Spy Optic Inc.'s servers.

Use of IP Addresses

An IP address is a computer identification number that is used any time your computer is connected to the Internet. Web servers, the computers that "serve up" web pages, identify your computer by its IP address. Spy Optic Inc. collects IP addresses for the purposes of system administration and to audit the use of our website. When visitors request pages from our website, our servers log the visitors' IP addresses. While we do store users' IP addresses along with their usernames and additional information, we DO NOT use this information unless we feel it is necessary to enforce compliance with our Terms of Use, or to protect our services, site, customers or others.

These advertisements are one more way that we help you find the products and services you need, and are delivered to users by our web advertising partners. If we decide to change our Privacy Policy, we will post those changes on this page and they will take effect in fifteen (15) days from posting.
